Electrical Utility Deregulation Essays - Electric Power Distribution
Electrical Utility Deregulation Electrical utility deregulation is the process of transforming electrical utility companies from regulated monopolies to market-driven suppliers of competitive energy and services. (Reliant Energy HL&P 1999) It means that customers will have the ability to choose their electrical supplier. Today's utility customers want lower prices, more choice, and better service as well as reliability. The deregulation of other industries such as railroad, trucking, natural gas, and telecommunications has shown people that choice can provide better value. The deregulated electric utility industry would look and act a lot like the long distance phone business. The market would set electricity rates. Sharp increases or decreases in the cost of fuel or customer volume would affect the prices. Prices have decreased even without deregulation however. According to the Edison Electrical Institute, real electricity prices have dropped 27 percent in the last 15 years. But with deregulation there is the potential that they will drop even more. The main issue that is of concern to electrical utility companies is stranded costs. Stranded costs are the past investments utilities were obligated to make in the regulated electric system. These investments were prudently incurred and government-approved to ensure reliability of supply and were partially recovered through customers' rates. (Reliant Energy HL&P 1999) Electrical utilities believe the recovery of past investments should be part of the overall deregulation process since they will be hard to recover in an open, competitive marketplace. If this issue is resolved to the satisfaction of the utility companies, it will open the way for deregulation. As stated in the previous page, the main obstacle to electrical utility deregulation is stranded costs. Two of the main issues surrounding stranded costs are their impact on electricity prices and stranded costs will affect the financial viability of an individual electrical utility. It is hard to determine exactly how much stranded cost will be. They have been estimated to be anywhere from 10 billion to more than 500 billion. And stranded costs may be higher in some parts of the country than in others. According to Research Data International, 86 percent of the stranded costs lie in 10 states that have 43 percent of the electricity market. California is at the top of the list, followed by New York, Texas, Illinois, Pennsylvania, New Jersey, Ohio, Georgia, Massachusetts, and Connecticut. The utility companies want to be able to recover most of if not all of their stranded costs, and if they are not able to electrical prices may be higher because of it. Another problem that has arisen is the concern over possible environmental and social protections built in through regulation would be lost. The Utility Workers Union of America believes that a competitive market would give profit driven companies an incentive to promote consumption, which would undermine many of the conservation programs that are promoted today. I think that we should not rush to judgement on these problems. Many states are implementing deregulation, and we will see exactly what happens and doesn't happen during these experimental times. Similar concerns were raised before the airline industry was deregulated, but it worked out just fine. There are 3 main objectives that electrical utility deregulation hopes to achieve. First and foremost are lower utility rates. Granted that utility rates are relatively low at the present time, with deregulation there exists the potential for them to be even lower. Businesses would have the most to gain from deregulation because of the large amounts of electricity that they utilize. They would be able to use the money saved on other methods or capital to better serve their customers. The everyday household would benefit because instead of having to purchase all the services from a utility company, they would have the option to purchase only some of them, or choose a different company of their liking. Secondly, better quality of service and product as a result of the competition is another objective of deregulation. With many different companies competing for customers, the companies will not benefit from producing an inferior product or poor service. The customers will simply take their business elsewhere. Prices will also be lower, because all the companies will be trying to entice customers with the lowest rates. Competition is what made the American economy into what it is today. It is a vital component of capitalism. The freedom of choice enjoyed in a capitalist system is so often taken for granted. It is what this nation was founded upon. The third objective of deregulation is the creation of more jobs through privatization. With deregulation there will be many more

Evaluation - Movie Review Example The story revolves around a family where the father is a loser, the mother is a drunkard and the protagonist is a frustrated son trying to escape such dilemma. To do so, he often goes to his friendââ¬â¢s laboratory. During one of his visits, his scientist friend shows his invention, a time-machine; when all of a sudden, a group of thugs riding a van shot at the doctor. As he tries to escape the criminals, Marty rides the time machine which brought him to the past. His travel did not only offer adventures but a chance to help his father become a better man. Indeed, this is a unique way of presenting the common plot of stories of making things right. The protagonist living in his parentââ¬â¢s teenage world is also a wonderful way of doing ââ¬Å"flashbackâ⬠although of course it is not called a flashback because the scenes should be current. With such presentation of the story, it is awesome to think about a story sequentially unfolds but still is able to bring the audience back to the past and back to the future. The plot is pure genius and it exceeds my expectation of a good plot. Theme should always be a criterion for judging a story especially when it extends to various aspects of life. Obviously, the theme of Back to the Future is about changing for the better, perseverance and love. Nevertheless, sometimes, it is not the obvious that makes things great but the inconspicuous. I agree with Rubin Safaya who wrote about easily dismissed scenes that portray a well-thought theme. In his article, Safaya mentions the joke about the former actor Reagan becoming the president and Lou becoming one of the early colored politicians (2010). Such portrayals imply the theme of living the American dream, that nothing is impossible for a person who is determined to make his way to success. The actors are have well-played their parts to make the story come to life. Among the many reviews on

What Role do Midwives Play in Supporting and Advising Women about the Research Paper
What Role do Midwives Play in Supporting and Advising Women about the Risk of Smoking During Pregnancy - Research Paper Example Though it is supposed that the role of midwives is limited to childbirth but this modern world has changed the role and responsibilities of midwives all over the UK. For instance, many of the midwives are now actively playing their role in health promotion. In fact, midwives are now taking health promotion more seriously as along with managing ill health and disease they also inform women about the ways to keep them healthy. Though the midwife has always been playing an important role in public health now it is important for them to divert their attention to teenage pregnancy, drug awareness, domestic violence and smoking cessation (Beldon et al, 2005). Here, you can easily see that the role of midwives is quite extensive but the help these midwives provide pertaining to smoking recession is remarkable. It is well-known fact that smoking is injurious to health and no one can deny this reality. But, the health implications of smoking can be even critical during the pregnancy. The worst thing is that smoking can not only hurt pregnant women but it is also perilous to the health of the unborn baby. Actually, it is said that baby smokes when a pregnant woman does that. As she inhales carbon monoxide and nicotine during smoking, the growing baby suffers as these substances are nothing less than poison. It doesnââ¬â¢t allow a baby to get enough oxygen or food. Smoking for pregnant women increases the chance of miscarriage. In addition to this, the chances of a baby coming into this world too soon will also be there. In this situation, the weight of a baby will always be on the lower side, giving rise to a lot of health issues. For these children, it becomes difficult to stay away from asthma or lung problem as they grow old (Smoking During Pregnancy). These are few of the issues associated with the smoking during pregnancy but it is a fact that lots of women donââ¬â¢t become able to quit smoking during pregnancy, even if they want to do so.à Ã

Biological Anthropological Analysis of Gorilla
Biological Anthropological Analysis of Gorilla Gorilla Biological anthropology is also known as physical anthropology, it is an interesting mixture of social studies and biology of people. This study concerned with the biological and behavioural aspects of human beings, and their related non-human primates and their extinct ancestors. To grasp how human evolution, occur from earlier life forms (primates). Primates include (Homo sapiens), the apes, the monkeys and gorillas. we can know about primate behaviour by studying them. If I would like to talk about gorilla. the largest of the living primates, it is ground dwelling herbivore animal that inhabits the forest of Africa. They are also known for their gentle human like behaviour and emotions such as laughter and sadness. They even make their own tools to assist them survive in the forest. Gorillas are stocky animals with broad chests and shoulders. Some of the body parts seem to be same as humans like hands and their small eyes set with hairless faces. They play a very important role in local biodiversity, roaming through large territories assist humans for example to spread the seeds of fruits they consume. Studies have shown gorilla blood is not reactive to anti-A and anti-B which would in humans indicate type O blood. Moreover, like humans, gorillas have different finger prints. Classification of Gorillas based on their species: Gorillas are our closest living relative after chimpanzees and bonobos. they are divided into two species; the eastern gorilla (G. g. diehli) and the western gorilla (G. g. gorilla). The eastern gorilla consists of two more sub-species. These species are the eastern lowland (G. B Graueri) and the mountain gorilla. (G. B. Beringei). Physical description: Gorillas are the largest living primates. They are stocky animals with broad chests and shoulders. Some of the body parts seem to be same as humans like larger hands, eyes, face.Ãâà There DNA is 97% 98% identical to that of a human. There forearms are much shorter than the upper arm. The face is black and hairless with small eyes that are close together and prominent nostrils. Adults males are identified by sagittal crest along the midline of the skull and a small are of white hairs on the black that is why they also known as silverbacks. Moreover, eastern gorillas have darker and longer fur on their arms whereas western gorillas have shorter hairs which grey or brown in colour. Size: adult males weigh up to 200kg whereas females have around half the size. They can reach the height of 1.2 to 1.7 meters when standing on two feet. Social structure of gorillas: They have a well-developed social structure. They forming stable family groups in which dominant male keep the position for years. Usually they are 5 to 10 individuals in one group or vary from 2 to over 50 members. Furthermore, if any male gorilla leaves the group, he wanders alone for many years. whereas female gorillas leave their group at maturity to join other group or single males. But it is very rare in female gorillas and they reproducing in their original groups. Life cycle of gorillas: Female gorillas become sexually mature at age of 7-8 years old. but they start breeding several years later. Whereas males are mature later than females. But some of the gorillas starts breeding before the age of 15 years. They have high infant mortality. There is long gestation to single births (8.5) months. Females generally give birth to three or four babies during their reproductive life. the mortality rate for gorillas is less than one year old is high, but for the adults the rate is only 5 %. In the wild they might live for 40 years old. in the united states, a captive gorilla was reported to have lived to the age of 54. Reproduction: Female will purse their lips and slowly approach a male while making eye contact. This serves to urge the male to mount her. If the male does not respond, then she will try to attract his attention by reaching towards him or slapping the ground. Males incite copulation by approaching a female and displaying at her or touching her. Male gorillas are not active in a caring for the young. But they do play a role in socialising them to other youngsters. the silverback has a largely supportive relationship with infants in his troop and shields them from aggression within the group infants remain in contact with their mothers for the first five months and mothers stay near the silverback for protection. Infants began to break their contact with their mothers after five months.by 12 months old infants move up to five meters from their mothers when they enter juvenile period at the third year and this last until their sixth year. Intelligence: Gorillas are considered highly intelligent. A few individuals in captivity such as koko, have been taught a subset of sign language like other apes, gorillas can laugh grieve have rich emotional lives, develop strong family bonds, make tools and think about past and future. Diet: Gorillas are mainly herbivorous(vegetation)and they spend almost half of the day in feeding on stems, bamboo shoots and a variety of fruits. How do gorilla communicate? As we know gorillas live in the dense rain forests where it is very difficult to see the group members. So, they use mainly vocalisation for communication in accordance with their role as group leader. For newly born babies of gorillas. Vocalisations (screaming)are the most way to attracting their mothers attention to their needs. However, body parts and facial expression also indicate the gorillas mood. Postures signalling mood or intention to the partner are sometimes even used for communication over greater areas. http://www.bing.com/videos/search?q=communication+videos+of+gorillasqpvt=communication+videos+of+gorillasview=detailmid=5DAF26CADB7EC10E05E75DAF26CADB7EC10E05E7FORM=VRDGAR Moreover, gorillas senses resemble those to humans. They also use the senses in their communication not only hearing and seeing, but also touching and smelling. Silverback males have a characteristic smell. In dangerous situations, they emit very specific scent that can smell from many metres that can help to alert the group without producing any noise. This is very rare that gorillas using tools in the wild. Western lowland gorillas have been observed using sticks to apparently measure the depth of water and as walking sticks to support their posture when crossing deeper water.an adult female used a detached trunk from a small shrub as a stabilizer during food gathering. Nesting : Gorillas construct nests for daytime and night use. Their nests are a simple aggregation of branches and leaves about 2 to 5ft and constructed by individuals. Molecular ecology of gorillas: Microsatellite analysis can reveal unexpected patterns of behaviour for example the high frequency of extra pair mating in socially monogamous birds [reviewed in griffin et al.,2002]. In animal groups, neither mating behaviour nor social dominance rank always predict paternity, and genetic analysis have revealed the presence of alternative, unobserved male mating strategies that produce a significant proportion of offspring e.g.., in grey scales. [Worthington Wilmer et, al., 1999]and free living sheep [colt man et al., 1999]. One of the earliest attempts to use a molecular approach to assess the genetic mating system in wild apes was made in a study of mountain gorillas however the conclusions were limited while most gorillas social groups appear to be composed of a single mature silverback male along with adult females and offspring, some 40%mountain gorillas group contained two or more silverback males [Robbins, 1999; Schaller, 1963; Webber and vedder,1983]. Reasons why gorillas are endangered? Habitat Loss, Reduction, and degradation. Poaching Poaching is the illegal hunting that can be used for commercial purposes. Poachers can kill gorillas to sell their meat and various body parts or some time they capture gorillas and keep them alive and use gorillas as private collection of animals. Diseases:à due to the genetic similarity between humans and gorillas, they are also victims of outbreaks that can affect people.one of the major virus is known as Ebola virus and poaching are the threats of the western lowland gorillas By 2003, one-third wild gorillas had died due to this virus. Other diseases affecting gorillas are polio, hepatitis A, tuberculosis and intestinal parasites References: http://www.worldwildlife.org/species/gorilla http://www.bing.com/videos https://www.defenders.org/gorilla/basic-facts Coltman DW, Bancroft DR, Robertson A, Smith JA, Clutton-Brock TH, Pemberto JM. 1999. As a little boy, I have always been interested with machines and mechanical engineering. Lego bricks got me interested with building all sorts of buildings, cars and even trains. I would like to learn the skills needed to build machines and produce them for a career. Smart and intelligent minds help to create marvels in transportation including the cars people drive every day. Designing and producing new machines can improve human activity from mechanical engineering. For example, automobiles and can be made to run better, worse or on completely different fuels to run at an enormous rate. Mechanical engineering runs the world and makes things happen with technology. Machines in factories make goods items to be sold for everyone to use such as the production of tools. The world revolves around these fields. Without mechanical engineering the world would be a much different place. The electronics, vehicles, and houses come into effect with mechanical engineering. A big jump wa s the industrial revolution that happened in the 18th century. New machines were created to help fulfill the needs of the people and are still being used today. Mechanical engineering breaks into many different fields including civil engineering and aerospace engineering. Civil engineering allows one to build buildings and forms of infrastructure. Examples would be bridges, tunnels; even the empire state building. Aerospace deals with aerodynamics improving speed and drag for travel in cars, trains, and planes. Aerospace is an expanding field with NASA to make spaceships travel with relative ease to cut down fuel usage to space. I would like to design the engines for motor vehicles and have it for a sports team. Mechanical engineering is a fiel... ...n water. The workout equipment was easy to clean, but not the uniforms. The way a business runs is not always easy and yet the customer does come first as well as a player in the sport facility. My mentor was one that showed a really perspective on how the real world runs in the today events. Ne moment there may be a ton of orders that are coming in for a place of a machine of store faculty will breakdown. The one thing I have learned no matter what from my mentor in job shadowing is to be ready and orgies to expect the good or bad occurrences. The reason for choosing the topic was a backup for a career it something goes wrong or that I donââ¬â¢t get involved in mechanical engineering. Sports business and training was the topic.

Curious Incident of the Dog in the Night Time review Essay
Plot: Christopher Boone lives with his father in a village. His mother died when he was younger from a heart-attack and the dad was left alone with the challenge of upbringing an autistic child who does not respond like a normal child would. The father has limited money and mental stimulants for the child and does his best to hold back his frustration. However, the reader soon learns that Chris has not been told the complete truth and perhaps that the people he loves have a hidden past. He then begins to understand what has happened and Mark Haddon portrays the challenges he is faced with without the constant safeguarding he needs to feel secure. My Thoughts: I understand that this book is renowned and took the book sales by storm; managing to pick up ââ¬Å"Best novelâ⬠and ââ¬Å"Book of the Yearâ⬠at the Whitbread book awards in 2003, but I do not find it at all appealing. I find myself unable to sympathise with Chris despite Haddonââ¬â¢s brilliant depiction of the mind of a child with autism, as Haddon does writes convincingly through the eyes of an autistic child. I do not think that this is a book that revolves around Asbergers; but instead about being different in general and Haddon is trying to make us see the world through a different lens. He just uses Asbergers as a means of conveying this. Furthermore, as Chris is very rational yet unemotional, there is no depth of character in the novel as Chris is only able to see the world through one plane and cannot build up good character depth, which most popular books have, eg. ââ¬â ââ¬Å"Harry Potterâ⬠and ââ¬Å"The Lord of the Ringsâ⬠. This direct approach also means that there is no humour apart from the main reoccurring joke of how Chris responds to things which lands im in all sorts of faux pas, (and the novelty of this soon wears off). However, this does not mean to say that I do not understand why it is so popular; it just isnââ¬â¢t something that really enraptured me, and to be honest, it seemed like a waste for a storyline that had the potential to be so rich in dramatic emphasis to be written in such a simplistic style. I have given it two stars but the average for this book is a four/five. Recommendations: If you liked this book I would strongly recommend these as they are both written in a diary style and are about people who do not necessarily fit the norm. Crown Prosecution Service Advice Essays
Crown Prosecution Service Advice Essays Crown Prosecution Service Advice Essay Crown Prosecution Service Advice Essay Crown Prosecution Service Advice Rhenium: Tom, Dick and Enid Introduction The undermentioned sentiments are premised upon the fact that from a procedural position, a figure of applications will probably be made by the prosecution to progress its chances at test. The first of these applications would affect the consideration as to whether it is preferred to continue against each of these suspects individually, or in a combination other than a three individual joint endeavor styled proceeding where all are charged as parties to the slaying of Charlotte. The main footing for separate proceedings is to avoid issues of admissibility of points of grounds that are potentially relevant to one suspect but potentially damaging to another. The suspects may besides raise the chance of a rupture. ( Smith, 1999, 859 ) topic to the flowering of the proceedings at the pre-trial phase, it may go desirable to break up the suspects where one may be in a place to attest against another. The sentiments as to the mode in which the grounds obtained in this affair may use refering each prospective suspect is hence considered in the absence of the impact of any procedural issues sing the indictment and the nature of the proceedings. Particularly, the tactical advantages of any rupture of each suspect or any peculiar count, is non considered below except where specifically noted. It is assume as a affair of fact-finding pattern that the constabulary would instantly hold sought a statement from Diane, so as to avoid the rumor jobs noted below. A concluding preliminary observation ââ¬â this analysis is structured so as to thoroughly use the general regulations of condemnable grounds, as opposed to mentioning fact specific an potentially mis taking instance jurisprudence. The instances cited are provided in promotion of this purpose. General Observations that apply to all suspects The grounds of Fay, age 10, is potentially relevant to all suspects with regard to Charlotteââ¬â¢s slaying. For this ground the place of Faye as a competent informant is considered independent of the analyses of the place of the suspects as set out below. Fay, like any informant is competent to give grounds topic to the procedural regulations specified at s. 53 of the Youth Justice and Criminal Evidence Act ( YJCEA ) . The competence of Fay will be foremost assessed by the test justice pursuant to the commissariats of s. 53 ( 3 ) , with the main consideration being that Fay be in a place to understand the nature of the proceedings and the nature of the inquiries asked. Base upon the limited grounds available at this minute, it does look probably that Fay will be able to pass on the awaited grounds in a manner that falls within the bounds of s.53. As an aside, given the nature of the charges, it is highly likely that consideration must be given to an application to seek the test courtââ¬â¢s permission to use one of the enumerated special measuresââ¬â¢ for this vernal informant as available through the application of the Criminal Procedure Rules ( 2005, R. 29.1 ) The 2nd facet to the appraisal of the grounds likely to be tendered through Fay is the fact that such grounds will be unworn grounds by virtuousness of the application of s. 55 ( 2 ) ( a ) of the YJCEA, given that Fay is less than 14 old ages old. The admissibility of Fayââ¬â¢s grounds will hence be determined by application of s.56 of the YJCEA, the commissariats sing the admissibility of unworn testimony. The weight to be given Fayââ¬â¢s grounds ( presuming that, as noted above, Fay is competent to attest in this manner ) will be a affair for the test justice to direct the jury in their direction ( Simmonds, 1996, 3 ) ; the weight to be given Fayââ¬â¢s grounds is needfully tied to the rumor concerns and the built-in dependability issues originating at that place, every bit good as the other fortunes noted below that a trier of fact can decently use to measure the weight to be given Fayââ¬â¢s grounds. These points are noted below. The primary analysis is directed to the facts as they pertain to Tom ; where appropriate, the possible liability of the other possible suspects Enid and Dick is considered at that point. Separate consideration of any issue particular to these suspects is besides delineated below. The Case against Tom Tomââ¬â¢s place may be assessed from a figure of positions. His instance may be developed on a figure of bases, peculiarly: ( 1 ) The appraisal of the obvious similar fact grounds and whether Tom could be convicted on such evince entirely ( 2 ) Assuming the admissibility of the similar act grounds, could Tom be convicted on the combined grounds of similar fact and the grounds of Fay sing his visit to her place with Enid and her observations sing the payment of ? 5,000 hard currency ( 3 ) Could Tom be convicted on the grounds of Fay, in concurrence with the grounds adduced in points ( 1 ) and ( 2 ) ; ( 4 ) The relationship between the prospective grounds of Fay and the grounds to be adduced at ( 1 ) , ( 2 ) and ( 3 ) 1. The similar fact grounds Given the general regulations sing the admissibility of such grounds, founded as it is upon the general regulation of probatory value versus the damaging consequence created by its admittance into grounds, it is of import to exactly place the facts available to the prosecution that may decently represent similar fact grounds. As is good known by virtuousness of the taking governments, peculiarly determinations such asPhosphorus( 1998, Crim LR 663 ) andHydrogen( 1995, 2 Cr App R 437 ) , the prosecution is non obligated to set up a dramatic similarity, mirror image type fact or any other suggestion that the facts, one to another, are indistinguishable. A high grade of similarity is clearly a trademark or dependability with regard to how a jury might be instructed as to the usage to which such grounds might be put in Tomââ¬â¢s test. Further, there is a clear chance to bolster the impact of this grounds through the other grounds considered at ( 2 ) , ( 3 ) and ( 4 ) below. With these rules in head, the followers is the form of similar act grounds to be considered: His clear form of imbibing, chancing and lifestyle that is a common yarn to all of the happenings taking to Charlotteââ¬â¢s slaying. His relationship with Dick that likewise is a common component to the full factual circumstance The slaying of two partners prior to Charlotte All three partners died by manner of a distinguishable slaying mechanism, a possible distinction and a factor that Tom might reason to extinguish the consideration of the earlier happenings as true similar facts ( knifing, hiting and Charlotteââ¬â¢s submerging ) . The prosecution will reason, and it is submitted, set up successfully, that the meeting of the factors of partner, domestic scene, Tomââ¬â¢s absence signifier the place at clip of decease, the comparative short continuance of the matrimony, and the farther facts in ( V ) rhenium motivation will probably over sit such statements. Motive ââ¬â Tom made a important fiscal addition as a consequence of the decease of each of his partners. Coupled with the lifestyle / chancing grounds available, this grounds is a portion of a compelling form of behavior Fortunes of his establishing of an alibi on three occasions, as established through the constabulary officers ; the possibility of Tom innocently happening himself in fortunes where an impregnable informant, a constabulary officer, is the party doing the topic telephone call on three occasions is one that defies common sense and forms a portion of the flowering of the narrative leading to Charlotteââ¬â¢s decease. Tom may be convicted as a party to Charlotteââ¬â¢s slaying on this grounds entirely if admitted in its entireness, taking as it does to the allowable illation that he must hold been an histrionat some degreein this slaying. ( Stewart and Schofield, 1995 ; Chan Wing-Siu, 1985 ; Roberts, 1993 rhenium: general rules ) 2. Dickââ¬â¢s payment to Enid This grounds assumes that Diane will supply this information through testimony and that it would non be tendered by manner of the triple hearsayââ¬â¢ implicit in the testimony of Fay ( in add-on to Fayââ¬â¢s unsworn informant position noted above ) . The payment of this big sum of money is admissible on its ain, but does non get peculiar cogency unless grounds of Enidââ¬â¢s position is admitted through the rumor noted from Fay, or unless Diane testifies. Dianeââ¬â¢s grounds refering Dick is non capable to any exclusion under the grounds jurisprudence ; it is admissible against both Tom and Dick. 3. Dianeââ¬â¢s grounds sing Enid Dianeââ¬â¢s grounds refering Enidââ¬â¢s admittance as a contract liquidator is hearsay in footings of its possible admissibility against Tom ( and Dick ) ; it is capable to the bridal considerations of compellability ( Civil Partnerships, 2004, s.84 ( 1 ) and ( 5 ) ) The rumor facets of the vocalization from Enid to Diane must be considered in visible radiation of the commissariats of the Criminal Justice Act ( CJA, 2003, s.118 ( 1 ) ) 4. Multiple rumor The facts present two different facets to this issue ââ¬â the grounds of Fay and the grounds of George. It is submitted that Georgeââ¬â¢s grounds is merely a farther patterned advance from that of Fay ; if Fay is found to be an undependable informant, it is non imaginable that Georgeââ¬â¢s grounds founded as it is upon Fay as a nexus in the evidentiary concatenation George would supply could be admissible and Fayââ¬â¢s non. The consideration must be hence directed to Fay. In add-on to the unsworn nature of the grounds, Fay is capable to consideration under the multiple hearsay proviso of the CJA ( s.121 ) . Taken merely as unsworn grounds from a kid, it is submitted that Fayââ¬â¢s testimony would be admissible capable to the weight to be ascribed to it. However, the extra factor of multiple rumor is a serious trouble for the prosecution 2. Extra considerations ââ¬â Dick The extent of Dickââ¬â¢s possible liability is hard to determine on the facts as presented. The saloon castanetss of his chancing relationship with Tom are present to make the causal connexion between them. However, without the grounds of Diane admitted as to the nature of Enidââ¬â¢s position this grounds does non make liability. However, Dianeobservedthe exchange of money between Dick and Enid, an observation that is admissible against Dick Diane nevertheless can attest as against Tom or Dick as to her conversation with Enid sing her slaying activity. Dick is apt as a party to the slaying of Charlotte if these facts are elicited as expected ââ¬â the relationship with Tom, the transportation of money to a admitted slayer, and the decease of Charlotte under fortunes consistent with the admittance by Enid to Diane support this contention. 3. Extra considerations ââ¬â Enid The confessionââ¬â¢ provided to Diane by Enid is capable to the exclusionary regulations noted above ( Civil Partnerships, s. 84. Absent this grounds, the facts admissible against Enid are reduced to the followers: an observation that Dick was in her company and paid her money Two other slayings took topographic point at an earlier tie connected to Tom. This grounds does non fulfill the grade of cogent evidence necessary to implicate Enid by manner of similar fact in the present happenings The admittance to Diane sing her homicidal activity can non be introduced indirectly via Fayââ¬â¢s hearsay if the substantial confession is inadmissible by jurisprudence. It is suggested from a tactical position that this possible informant be provided with unsusceptibility from prosecution and that she be called to attest against Dick and Tom. Strategic Analysis (SWOT and PEST) of Elecdyne The WritePass Journal
Strategic Analysis (SWOT and PEST) of Elecdyne SECTION 1 Strategic Analysis (SWOT and PEST) of Elecdyne SECTION 1INTRODUCTIONSWOT ANALYSIS OF ELECDYNEPEST ANALYSISFinal Recommendations:SECTION 2METHODOLOGYINTERNATIONALIZATIONCHINAINDIABRAZILCOUNTRY OF INVESTMENTREFERENCESRelated SECTION 1 INTRODUCTION As it is written in the case study about Elecdyne that the company is actually facing problems and is unable to grow itself since the last 2 years. Elecdyne is a Japanese company based in Tokyo and was established in 1990. They initially started with 5 employs and now it has 100 employs producing a range of Elecdyne products such as televisions, VCRs, DVD players, MP3 players, hi-fi equipment etc using technology licensed from a number ofà Japanese and European multinationals. It currently supplies only to the Japanese market. The problems that Elecdyne is facing is the general threats (and opportunities) that is been created by an increasingly globalized business environment like innovations in the products, rapid increase in the technology and changing in the nature of competition. Now the company needs to focus on how it will come out of this situation through an analysis and SWOT analysis will give a brief idea about the companyââ¬â¢s internal and external factors. SWOT ANALYSIS OF ELECDYNE Before we do a swot analysis of Elecdyne first we should what actually swot analysis is? SWOT analysis is basically method to look at the strengths, weaknesses, opportunities and threats of any company. Usually we do swot analysis just to see at the internal and external environment of the country just to analyze the environment that whether the conditions are favorable or not. This techniqueà was created by à Albert Humphrey. PEST ANALYSIS Before doing pest analysis first we should know about pest analysis. PEST analysis has 4 things in it which are Political, Economic, Social and Technological. The reason of doing it is to know about the macro environment. ââ¬Å"In analysing the macro-environment, it is important to identify the factors that might in turn affect a number of vital variables that are likely to influence the organizationââ¬â¢sà supply and demandà levels and its costsâ⬠(Kotter and Schlesinger, 1991; Johnson and Scholes, 1993). ââ¬Å"PEST analysis is a useful strategic tool for understanding market growth or decline, business position, potential and direction for operations.â⬠(Kotler 1998) Final Recommendations: The above analysis shows the current situation of Elecdyne and it shows that the company is in a very bad position. To get out of such situation the company needs to make some strategies and these strategies are discussed below: As we know that Elecdyne is working in the Japanese market since the last 20 years and so they have a pretty good knowledge about Japanese market. Their experience can play a vital role in operating in that huge market. First of all they have to do some research and find out that what type of products do customer need and should focus on that. As Elecdyne is not very much advanced in the technology so of course they should also focus on the technology. For example now Blu-ray technology is getting very common in the world and Japan being a very advance country in technology so Elecdyne should focus on improving the technology in its products. Another problem that Elecdyne is facing that its losing its key employs and it should focus on retaining them. Elecdyne needs a cheap labour which is very difficult to find in Japan because in Japan the wage rate is very high so Elecdyne needs to relocate their location and look for some place where there is very cheap wage rate and they should also look for low price raw material so that the production cost can also reduce. Recently japan has been from the worst disaster of earthquake so Elecdyne can also focus on the CSR activity by which their name can also be known in the social activity in Japan. Elecdyne should also focus on technology for selling its products all around the world and the best way of doing that is the internet. If people from all around the world can get access to the rpoducts of Elecdyne so their sale can increase but as I have mentioned above that they should try to reduce the prices of their products because the biggest competitor Elecdyne has is Sony which is a huge name in world and of course if the products of Sony and Elecdyne will be of same price so people will definitely prefer Sony but if Elecdyne products will be cheaper so people might choose the products of Elecdyne. The main strategies that Elecdyne should focus on are as follows: Relocation of production where there is cheap labour and raw material. Should improve the technology. Make easy access of their products all around the world through the internet. SECTION 2 Elecdyne is a Japanese company which is operating in Tokyo and currently only selling their products to the local market. As the current situation of the company is below average and it has stopped growing since the last 2 year and due to that it has start losing its key employs to their competitors. Now the company is focusing on internationalization and looking to relocate the company and want to minimize its cost. They are looking for cheap labour rate and cheap raw material which is not possible in Japan because Japan labour rates are high. The employs of Elecdyne are well educated and most of them have done their higher education from USE, CANADA and UK which clearly means that when going internationally English landguage is not going be an issue for the emplos. As I have mentioned before that main reason of going to another country is to minizing the cost. METHODOLOGY The method that will be used is PEST analysis which actually focuses on the macro environment of the country. INTERNATIONALIZATION After having lots of discussions and meetings among the top management the three countries that they have decided to choose are, China India Brazil CHINA China is one of the biggest countries of the world having the area of (3,705,407 sq mi) (wikipedia.com) with the biggest population (1.3 billion) (google.com 2011). China currently has the GDP of $4.99 trillion (google.com) with a growth rate of 9% (tradingeconomics.com). China today is one of the biggest industries of producing goods because of its cheap labour and huge man power. The policies of Chinese government are relatively easy and most of the products are produced or assembled in China. When investing in China the companies 1st should look at the Marco environment of the country and for doing that pest analysis is the best way of doing that. INDIA India again is one of the biggest countries of the with the population of 1.17 billion (google.com) with the total land of 1,269,219 (sq mi)à which is 7th in world (Wikipedia.com). Since the last decade Indiaââ¬â¢s economy has been boosting up doing to lots of foreign investments. The GDP of India is 1.31 trillion US dollars (google.com) with a growth rate of 8.3% and ranking 10th in the world as far as growth rate is concern. In India when companies want to invest so there are no complications when it comes to the government policies because the companies only need to report to RBI (Reserve Bank of India). The Indian government also support the FDI (Foreign Direct Investment) and the taxes on the business sector are not very high so this also gives a relief to the foreign investment. India has a very huge man power as they are 17.3% of the world population (Wikipedia.com) and due to this the labour rate in India is relatively cheaper than other countries of the world. To see t his in more details the pest analysis of India will give a much better idea of the Macro environment of the country. à à à à à à à à à à à à à à à à à à à à à à à Political à à à à à à à à à à à à à à à à à à à à Economic Government supports the FDI For industries taxes are very low. No precedning approval needed. The company only has to report to RBI(Reserve Bank of India) within 30 days of foreign investment Labour is relatively cheaper Has enough man power Boost in the GDP in last decade ($1.31 Trillionà US dollars) à à à à à à à à à à à à à à à à à à à à à à à à à à à à Social à à à à à à à à à à à à à à à à à à à à Technological Can decrease the unemployment in the country. Has a rapid increase in the technology in the last decade. BRAZIL Brazil is another country whose economy is boosting up. We have talked about India and China but Brazilââ¬â¢s economy is also rapidly increasing and currently its GDP is $1.57 Trillion US dollars (google.com) and the rate from which it is increasing is with the rate ofà 0.7% (tradingeconomics.com) in the last year. The government of Brazil is inviting the international business which is resulting in less employment and increase in the economy. The trading policies are also not very strict and taxes for trading are relatively low. The only issue that Elecdyne can have is Brazil is very far away from Japan and the cost in the logistics will be high. The government of Brazil also supports the FDI To see that Brazil will be a good option for Elecdyne to invest here is the pest analysis of Brazil. COUNTRY OF INVESTMENT As we have done pest analysis of 3 countries to find out that in which we have to invest and by doing that what I will recommend is to invest in India. India is one of the biggest democratic country of the world. The very first reason of doing this is the tax rate of India on the business is very low and India government is still looking for foreign companies to invest in their country and the biggest reason of doing is to decrease the unemployment from the country. Being the 2nd biggest country in the world (as far as population is concern) the employment in India is still a problem with the people of India. The only problem that Elecdyne might have in India is there is some corruption in the government. If we see into this so this may not effect Elecdyne but still there might be a possibility that this might affect the company. Another factor that India has a very low labour rate and if we compare the currency of India and Japan so there is not a very huge difference but if we comp are the currencies of other countries that we have analysed so India will be the cheapest. When it comes to logistics so the distance between the two countries is not too much. The transportation that can be used are, rail, trucks, plane etc. India is a very advance country and they also have technology and if Elecdyne need some technology they can import it without worrying of high taxes. When investing in India Elecdyne is not require to wait for a long time all they have to to do id the report to the RBI( Reserve Bank of India) just before the 30 days of investment. Since the last 6 or 7 years now the stability in India is very good and companies who have invested in India have minimize their cost and due to a huge population in India the number of buyers have increased. The biggest competitor of Elecdyne is Sony and as we discussed above that Elecdyne have to minimize the price of its products so that people prefer their products because of low price there are people in India wh o are price oriented rather than quality so in my opinion India is the best country to invest. Salem Witch Trials Research Paper Example | Topics and Well Written Essays - 1500 words
Salem Witch Trials - Research Paper Example The outcome was sure but not short. The female convict often with her baby, were put to hellish inferno till their last breath. The following paper highlights those torments that the women had endured in the background of Salem Witch Trials. Witchcraft and black magic had always cast deep horror and doubt among human beings, belonging to different strata and countries of the world. Anything that apparently unexplainable through common sense or substantial investigation had either been termed as divine or evil. In this battle of two extremities the later often gained much weight out of the fear of the common people. Like other countries of the world United States of America (USA) was no exception regarding its attitude towards witchcraft and subsequent steps and trials that had been taken against the same. Among them Salem Witch Trial might be considered as the most significant that had paved a new angle to that atrocity. Marilynne K. Roach describes Salem witch trials as ââ¬Å"one o f the American historyââ¬â¢s favorite stereotypes of intolerance and superstition, a tragedy with popular associations of magical evil and Halloween jokesâ⬠(Roach, 2004, p.xv). ... 59). As time passed by, the colony admitted to the fact that the results of the trials were mistakenly interpreted and the convicted families were compensated accordingly. The shadow casting of the trials brings with it the essence of paranoia and injustice within the quintessence of the populace of the later times. Boiling down to a pinpoint inspection it can be inferred that the victims were women and they faced the evil consequences. Varied ideas are associated with the Salem witch trials like the outgrowth of conflicts among the merchant and trading class alone with the disposition of the Puritanical doctrine. Again this paper will drive its omnipotent focus on the role of the women and their perils in the society of that at the background the periphery of Salem Witch Trials. The Salem Witch trials highlighted the fact that the colonial New England was subject to subordination along with immense oppression towards women of any age and that often came behind the veil of superstiti on as a justification of those heinous offenses. Disintegrated into a prosperous town and a farming village the inhabitants of the Salem village were basically in a dilemma to seek either ecclesiastical or political independence from the town. In 1689, after winning the rights of establishing their own church, the villagers had chosen the monk Samuel Parris as their minister who was a merchant before adopting priestly hood. Parrisââ¬â¢s perturbed exploitative mechanism of appropriation led to the generation of rigorous friction amongst the inhabitants and that eventually resulted in termination of salary contribution in October 1691. In 1685, King James II's

Government power and individual safety Essay Example | Topics and Well Written Essays - 1000 words
Government power and individual safety - Essay Example Any person should expect a semblance of safety also in his/her home and community. This means that the government will have the power to enforce laws and regulations that prevent people from trespassing in and damaging other peopleââ¬â¢s private property, for example. The government uses the police to catch criminals violating individual safety. At the same time, there should be a legislative component that tries suspects of these crimes. For example, if someone kills a person, this act gross violates individual safety. The government must then use its police and court system to ensure that the violated right of safety will be promoted and that justice will be served. The promotion of individual safety, however, should not undermine national safety. National safety refers to overall wellbeing of the people or of a large group of people. For instance, it can refer to protecting the life of a city. Terrorism directly impacts and kills numerous of lives and the government has once pr ioritized the protection of national safety over that of individual safety. Individual safety is important, but when national safety is paramount, the latter can be given emphasis by the government. A society without a governing authority will have no social order, and hence, no enjoyment of social liberties. The government needs power to have the ââ¬Å"authority to set and enforce limits on individual freedom to maintain social orderâ⬠for without social order, individual liberties will be meaningless (Bond and Smith, 2010, 114). Without a governing authority, any person can directly infringe on the personal freedoms of others. Criminals will fear no punishment, since there is no government. Crime rates will soar. People will no longer respect contracts and agreements. There will be no peace and social order. Chaos will reign. It is through a legitimate governing authority that social order will be implemented and individual liberties will have realization. This essay shows t hat the government should have enough power to secure individual safety, but not to the extent of sacrificing national safety, and that a society without a governing authority will have no social order, and hence, no enjoyment of social liberties. The government should promote individual safety and protect the rights of the individual, but national safety often is more important than individual safety. Finally, a legitimate governing authority provides social order will be implemented, where individual liberties will have realization and protection. Political Ideology: Individual and Social Progress or for Power and Influence over Society Political ideology refers to the set of beliefs of ââ¬Å"what the government should doâ⬠(Bessette and Pitney, 2011, 252), as well as to the cultural, economic, social, and political beliefs of the majority of society. It means that it
